Birthday Party Terms and Conditions and Policies

This Birthday Party Agreement, Terms & Policies (“Agreement”) governs all birthday party bookings at Jetsetter Kids Club, operated by Discovery Kids Wellness LLC (“Jetsetter”). By booking a party, submitting payment, or attending the event, the client (“Client”) agrees to be bound by all terms, conditions, and policies set forth below.

1. Agreement & Scope of Services

Birthday party packages include use of designated party space, hosted playtime, staff support, and the services outlined in the selected package at the time of booking.

Services are deemed fully rendered once the party occurs on the scheduled date and time. Minor operational adjustments or substitutions that do not materially alter the overall experience do not constitute failure to provide services.

2. Booking, Deposit & Payment

A non-refundable deposit of 50% is required to secure the party date and time.
The remaining balance is due fourteen (14) days prior to the event date.
Parties are booked on a first-come, first-served basis and are not confirmed until the deposit is received.
A $400 refundable security deposit is collected prior to the event to cover potential damages, overtime, or additional guests.
The security deposit will be refunded within one (1) week after the party, provided no additional charges apply.
If damages, overtime, or additional charges exceed the security deposit, the credit card on file will be charged for the remaining balance. By booking, the Client expressly authorizes Jetsetter to process such charges.
A 10% Service Charge is automatically added to all party bookings to support event staffing, preparation, setup, breakdown, and operational costs.
Applicable sales tax is added to all bookings.
Accepted payment methods include credit card, debit card, Zelle, or ACH transfer.
All pricing is final and non-negotiable and reflects reserved capacity, staffing, preparation, and operational costs.
Failure to remit payment when due may result in cancellation without refund.
All sales are final. Except as expressly stated in this Agreement, all payments made to Jetsetter Kids Club are non-refundable.

3. Cancellations, Rescheduling & No-Shows

Deposits are non-refundable under all circumstances.
Cancellations made more than fourteen (14) days prior to the event may receive a refund of payments made beyond the deposit only.
Cancellations made within fourteen (14) days of the event are non-refundable.
One (1) reschedule may be offered at Jetsetter’s discretion, subject to availability.
No-shows or cancellations within seven (7) days of the event are non-refundable and not eligible for rescheduling.
Rescheduling due to illness of the birthday child requires a medical note and is eligible for rescheduling only, not refunds.
For clarity, all sales are final, and no refunds or credits will be issued for cancellations, no-shows, reduced attendance, or unused services.

4. Guest Count, Attendance & No-Shows

Each party package includes a set number of children and adults as specified at booking.
Jetsetter is not responsible for guest no-shows.
No refunds, credits, or adjustments will be issued for guests who do not attend, arrive late, or leave early.
Party pricing is based on reserved capacity, staffing, food preparation, and facility usage, not actual attendance.
Additional guests must be approved and paid for in advance.
Maximum guest limits are strictly enforced.

5. Party Execution & Issue Resolution

Any concerns must be raised during the event to allow for real-time resolution.
Issues not communicated during or immediately after the party are deemed waived.
Post-event dissatisfaction does not entitle the Client to refunds, credits, or chargebacks.

6. Waivers

All guests must complete a waiver prior to entering Jetsetter Kids Club.
Guests without completed waivers will not be permitted to participate in play activities.

7. Food, Décor & Third-Party Vendors

Jetsetter provides tableware, pizza, and a juice box for children based on the selected package.
Outside food or beverages for children are not permitted, unless approved in advance for allergy or religious reasons.
Adult food packages are available. Outside adult catering is not permitted unless requested and approved in advance.
Clients may bring their own cake.
Custom décor or balloon installations must be coordinated in advance.
No confetti, glitter, or wall attachments (including tape, pins, adhesives, or hooks) are permitted.
Jetsetter is not responsible for third-party vendors or deliveries. Damage caused by décor or vendors will be charged to the Client.

8. Play, Safety & Conduct

Grip socks are required for all children participating in play areas.
Adults and caregivers may wear regular socks; shoes are not permitted in the play space.
Jetsetter staff assist with hosting but are not responsible for individual child supervision. Adult supervision is required at all times.
Unsafe behavior, rule violations, or damage to the facility may result in immediate termination of the party without refund.
The Client is responsible for the conduct of all guests and for any resulting damages.

9. Photography & Media Release

Jetsetter may take candid photos or videos during the event for promotional purposes unless the Client opts out in writing prior to the party.

10. Chargebacks & Disputes

By booking, the Client agrees not to file chargebacks for services that were fully rendered.
Chargebacks submitted without first contacting Jetsetter will be formally disputed.
This Agreement, booking confirmations, policies, receipts, communications, and proof of service will be submitted to payment processors as evidence.
The Client acknowledges that all sales are final once services are rendered and agrees that chargebacks based on attendance, satisfaction, or post-event claims are not permitted.

11. Limitation of Liability

Participation is at the Client’s and guests’ own risk and is subject to signed waivers. Jetsetter is not responsible for personal injury, loss, or damage except to the extent caused by gross negligence or willful misconduct.

12. Governing Law

This Agreement is governed by and construed in accordance with the laws of the State of New York.

Client Authorization

By booking a party, you acknowledge that all sales are final and that this Agreement has been reviewed prior to booking. You authorize Discovery Kids Wellness LLC dba Jetsetter Kids Club to keep a credit card on file and to charge for:

Damages to the facility, equipment, or property
Overtime beyond the contracted party duration
Additional guests beyond the package limit
